Faulkner a bâti une partie de sa renommée sur la violence parfois controversée de ses récits. Mais l’acte criminel retient moins son attention que son contexte et sa signification morale. L’objet premier de la littérature, selon Faulkner, ce sont les conflits de l’homme, ou du cœur humain, avec eux-mêmes. Le propos de cet article est de mettre en évidence la façon dont Faulkner subvertit le modèle du roman noir, et substitue à l’enjeu traditionnel des histoires policières, celui des faits et (...) de l’identité du coupable, un problème moral. Il donne quelques indications sur la structure générale des rapports crime-culpabilité dans l’œuvre de Faulkner, avant de montrer comment cette thématique se décline dans ses « histoires de crime » au sens propre, c’est-à-dire dans L’Intrus (Intruder in the dust, 1948) et Le Gambit du cavalier, et irrigue la reconstitution faulknérienne de la société du Sud et de l’histoire des États-Unis. This research investigates the determinants of entrepreneurial intention among Vietnamese employees, a crucial segment of potential entrepreneurs yet mostly neglected in previous studies. Given the focus on intention to create an international business venture and the working segment, we expand the entrepreneurial event theory by supplementing perceived competence and job satisfaction as determinants of entrepreneurial intention while testing the mediation of perceived feasibility and perceived desirability in such relationships correspondingly. Three focus groups on 27 Vietnamese employees were conducted to explore (...) the specific relevant competences and develop the conceptual model. Afterwards, data from an empirical survey on 567 Vietnamese employees was analysed using a partial least squares structural equation model to test the hypothesised relationships. The empirical results indicate that perceived competences, viz. administrative competence, communication skills, network building competence, and international business expertise have a positive impact on entrepreneurial intention. This paper endeavors to understand the research landscape of finance research in Vietnam during the period 2008 to 2020 and predict the key defining future research directions. Using the comprehensive database of Vietnam’s international publications in social sciences and humanities, we extract a dataset of 314 papers on finance topics in Vietnam from 2008 to 2020. Then, we apply a systematic approach to analyze four important themes: Structural issues, Banking system, Firm issues, and Financial psychology and behavior. Overall, there have (...) been three noticeable trends within finance research in Vietnam: (1) assessment of financial policies or financial regulation, (2) deciphering the correlates of firms’ financial performances, and (3) opportunities and challenges in adopting innovations and ideas from foreign financial market systems. Our analysis identifies several fertile areas for future research, including financial market analysis in the post-COVID-19 eras, fintech, and green finance. (shrink)

Le problème de l’induction (humien) a récemment été abordé par Steel dans son article de 2010. Celui-ci soutient que les théories d’apprentissage formelles permettent de justifier logiquement le principe de l’induction, ce dernier assurant la fiabilité logique des méthodes. Cette proposition a été critiquée par Howson en 2011, ce dernier mettant en doute la possibilité même qu’une méthode puisse être logiquement fiable. Bien que Steel ait offert une réponse à cette critique, il n’y répond pas directement. Dans le présent article, (...) une réponse frontale à celle-ci est offerte en s’inspirant des pratiques de tests d’hypothèses en sciences biologiques. Pour ce faire, une règle de construction des ensembles d’hypothèses est proposée, règle offrant une justification logique au fait qu’une méthode convergera nécessairement vers la vérité. Cet amendement étant cohérent avec l’ensemble de la proposition de Steel, il est ainsi possible d’affirmer que sa thèse est renforcée par cette proposition. (shrink)

Experimental philosophy of consciousness aims to investigate and explain our thinking about phenomenally conscious states. Based on empirical studies, researchers have argued (a) that we lack a folk concept of consciousness, (b) that we do not think entities like Microsoft feel regret, (c) that unfelt pains are widely accepted, and (d) that people do not attribute phenomenally conscious states to duplicated hamsters. In this article, I review these and other intriguing claims about people’s understanding of phenomenal consciousness. In doing so, (...) Sa carrière extraordinaire s’est vue favorisée par l’absence presque totale d’intérêt, de la part des philosophes analytiques ou des autres philosophes «exacts», pour ce que le philosophe australien David Stove appelle «la nosologie de la philosophie»2, l’exploration des multiples formes qu’a prises la mauvaise philosophie. Stove indique qu’une telle entreprise implique qu’on fasse de l’histoire. Selon une réponse populaire, toutes les propriétés ne sont pas également fondamentales : certaines sont fondamentales ou rares (« sparses »), tandis que d’autres ne le sont pas. Le modèle unificationniste de l’explication métaphysique, basé sur les travaux de Kitcher sur l’explication scientifique, offre une alternative intéressante aux modèles présumant la conception supportive de l’explication métaphysique [backing model]. Par contre, le caractère adéquat de ce modèle, i.e. sa capacité à classifier comme métaphysiquement explicative/non-explicative des propositions qui préthéoriquement sont classés comme tel, n’a pas encore été exploré. Pour ce faire, des interprétations pour les relations de détermination et d’appartenance à un ensemble sont fournies. Celles-ci étant potentiellement sujette au (...) problème d’artificialité, i.e. présence d’un biais structurel favorisant l’attribution du caractère explicatif, une réponse est offerte. En effet, le modèle unificationniste permet d’identifier les patrons argumentatifs pouvant être légitimement mis en compétition en comparant la distance entre les ensembles de faits qui doivent être considérés comme vrais dans la formulation d’un patron argumentatif. Cette propriété a des conséquences intéressantes dans l’identification du niveau adéquat de débat entre des propositions compétitrices. (shrink)

La neutralité axiologique est souvent présentée comme une vertu professorale, ou comme une composante essentielle d'une déontologie de l'enseignement. Nous mettons cette conception de la neutralité axiologique à l'épreuve, notamment parce qu'elle ne permet pas d'expliquer 1) l'importance d'un enseignement diversifié, 2) l'importance, pour les personnes subissant une influence illégitime, d'avoir des recours institutionnels, et 3) l'importance qui devrait être accordée par l'Université à l'autonomie des étudiant-e-s. Pour ces raisons, nous proposons plutôt d'interpréter la neutralité axiologique comme une exigence institutionnelle, (...) exigence compatible avec une certaine tradition de la liberté académique. L’objectif de cet article est double. D’une part, il vise à identifier une interprétation éthique de la neutralité axiologique, et non de réduire ce critère à des considérations épistémologiques comme la distinction entre faits et valeurs. On peut, en effet, interpréter le critère de neutralité axiologique comme un mécanisme visant à défendre l’autonomie des différents membres de la communauté universitaire. D’autre part, cet article entend utiliser cette interprétation éthique pour répondre aux critiques contemporaines de la neutralité axiologique. Amartya Sen et (...) Hilary Putnam ont proposé des critiques pertinentes de la neutralité axiologique, en réfléchissant sur les conditions d’objectivité du discours éthique et politique. Au terme de cette analyse, nous proposerons une conception publique de la science, qui répond à l’impératif éthique de neutralité en sciences sociales, ainsi qu’au programme de recherche amorcé par Sen et Putnam. L’examen critique et public de la science est ce qui permet de respecter tant l’exigence de neutralité chez Weber que la demande d’une science renouvelée chez Sen et Putnam. (shrink)

Cet article a deux objectifs. Le premier est de montrer pourquoi l’argument instrumental en faveur de la démocratie est insuffisant pour justifier la délibération politique. Si notre but est l’optimisation du potentiel épistémique d’un régime politique, et que des approches agrégatives et inférentielles (sans délibération) atteignent cet objectif, alors nous ne pouvons plus justifier la délibération sur cette base. Ce problème peut être contourné en reprenant une distinction de Daniel Andler. Pour ce dernier, le groupe délibératif se distingue du groupe (...) agrégatif parce qu’il permet aux agents, par une occasion éducative informelle, de se responsabiliser. La délibération présente donc un potentiel épistémique supérieur, mais qui ne se limite pas à identifier la meilleure réponse dans un temps donné. Le second objectif de l’article est de montrer comme l’argument d’Andler fait le pont entre, d’une part, les théories de la justification publique et, d’autre part, les théories de la démocratie épistémique. Que les récits utopiques et contre-utopiques sont-ils censés nous apprendre que nous ne sachions déjà – que l'état du monde pourrait être meilleur, ou pire, qu'il n'est ? Qu'ont-ils à nous dire de la sanction pénale, comme concept et comme pratique, et que celle-ci nous apprend-elle en retour des limites de l'utopie comme récit et comme discours ? En mettant l'accent sur les références explicites, dans 1984, à la suppression systématique de tout ce qui pourrait ressembler à une règle, et (...) en resituant le roman dans le contexte social et colonial de l'expérience orwellienne de l'injustice pénale, cet article montre que les lectures d'Orwell inspirées de Rorty, Foucault et Deleuze, et centrées sur les notions de pouvoir, de discipline et de contrôle, manquent en partie leur objet. Ni simple « satire », ni « prophétie », ni « expérience de pensée », 1984 exprime la grammaire profonde de notre conception libérale du droit pénal, comme le dirait Wittgenstein. S'il n'est jamais question pour Orwell de dénoncer l'utopie comme intrinsèquement dangereuse, 1984 révèle toutefois qu'il est impossible d'en saisir l'élément de perfection par le droit. En ce sens, la « dernière utopie » des droits humains (S. Moyn) n'en est pas une. --- What are we supposed to learn from utopian/dystopian fiction – beyond the obvious fact that the state of the world could be better, or worse ? What can these fables tell us about criminal penalty as a concept and as practice ? Conversely, what can punishment tell us of the limits of utopia as a tale and as discourse ? By stressing 1984's explicit references to the meticulous elimination of anything vaguely resembling a rule, while putting the novel in the perspective of Orwell's social and colonial experience of penal injustice, this paper shows that interpretations of Orwell inspired by the likes of Rorty, Foucault or Deleuze, which are grounded on power, discipline or control, somehow miss their target. No mere “satire” nor “prophecy”, nor even “thought experiment”, 1984 expresses the deep-seated grammar of our liberal conception of penal law, as Wittgenstein would put it. While Orwell aims in no way to dismiss utopia as intrinsically dangerous, 1984 however shows that the element of perfection it contains cannot be grasped by law. In this respect, the “Last Utopia” of human rights (S. Moyn) is certainly not one. (shrink)

Cet article poursuit la réflexion de Dilhac (2014) touchant la relation entre politique et vérité. Au terme d’une analyse de la tolérance chez Mill et Popper, Dilhac conclut qu’une conception épistémique de la tolérance manque sa dimension politique, et qu’il est préférable d’opter pour le concept rawlsien de consensus raisonnable. Discutant ces résultats, le premier objectif est ici de montrer qu’une notion de « raisonnabilité » peut facilement trouver ses racines dans la neutralité scientifique wébérienne, et donc être porteuse d’une (...) dimension épistémique minimale. Le second objectif est de clarifier l’impact de cet argument particulier sur le débat général entourant la démocratie épistémique. Il sera défendu que l’opposition traditionnelle entre les conceptions épistémique et politique de la délibération est à trouver dans un certain perfectionnisme épistémique, mais qu’il existe au moins une conception minimale du potentiel épistémique tout à fait compatible avec les valeurs fondamentales du libéralisme, comme l’inclusion, l’égalité ou la diversité. En d’autres termes, les exigences épistémiques minimales de la neutralité scientifique peuvent être indépendantes du perfectionnisme épistémique. (shrink)

Un biologiste fait une découverte incompatible avec des conceptions religieuses de la vie bonne. En classe, un professeur d'université profite de son exposé magistral pour faire la promotion d'une idéologie politique. Un fonds de recherche des sciences sociales refuse de financer un projet visant à résoudre le problème de la sous-représentation des femmes en politique, affirmant qu'une telle recherche n'est pas scientifique. Tous ces exemples témoignent de l'interaction constante entre, d'une part, l'enseignement et la recherche scientifique, et d'autre part, les (...) enjeux normatifs au sein de sphères d'influence. Les sciences doivent-elles être neutres? La normativité des sciences est-elle inévitable? Et de quoi parle-t-on lorsque nous faisons référence à la neutralité scientifique? Cette entrée exposera les principales réponses à ces trois questions. Après avoir clarifié le cadre conceptuel et la problématique de cette entrée, nous explorerons les approches wébérienne et positiviste en faveur de la neutralité des sciences. Ces deux perspectives seront confrontées à divers objections, notamment celles du pragmatisme américain. En réponse à l’ethos mertonien des sciences, nous présenterons finalement la critique féministe selon laquelle les disciplines scientifiques ne peuvent pas faire l’économie d’objectifs éthiques, politiques ou sociaux. Pour des raisons de simplicité, cette entrée approfondira surtout des modèles et arguments issus de l’économie, de la biologie et des sciences de la santé, des disciplines ayant été au cœur des controverses entourant la neutralité des sciences. Une des contributions phares de Luc Bégin à l’éthique publique est d’avoir bien documenté les obstacles auxquels les gardiens institutionnels québécois doivent porter une attention particulière. Bégin s’est notamment intéressé aux conditions dans lesquelles les ordres professionnels, comme l’Ordre des ingénieurs du Québec, sont moins susceptibles de protéger le public contre des pratiques répréhensibles (corruption, collusion, etc.). Je poursuis les réflexions de Bégin à partir d’un point de vue « épistémique ». Je montre d’abord comment les ordres professionnels ont tendance (...) à produire des connaissances sur l’état de la profession à partir des informations partagées par leurs propres membres. J’analyse comment cette pratique peut générer un biais du survivant, et obscurcir des problèmes centraux à une profession. Finalement, je propose des pistes de solution à ce problème pour les ordres professionnels. (shrink)

Abordant les alternatives au capitalisme dans la pensée de Léon Bourgeois, Éliot Litalien commente La Solidarité et Simon-Pierre Chevarie-Cossette s’attaque à l’analyse de l’Essai d’une philosophie de la solidarité. Enfin, en liant capitalisme, patriarcat et pouvoir politique, Tara Chanady propose une lecture du texte Du mariage et de l’amour de Emma Goldman. La conclusion de Marie-Eve Jalbert se situe dans une perspective contemporaine et critique en décortiquant la critique du socialisme avancée par Friedrich A. Hayek. (shrink)

Pourquoi accorder un rôle essentiel à la délibération publique dans le choix des normes éthiques et politiques guidant les sciences? À partir d’un débat récent en économie du bien-être, cet article soutient que l’introduction de normes éthiques et politiques en sciences doit respecter le principe de neutralité procédurale, et qu’une délibération publique bien encadrée respecte ce principe. Je présenterai deux raisons de croire que les sciences doivent respecter la neutralité procédurale. Le premier argument est lié au rôle que devrait jouer (...) l’examen libre et critique dans le développement des sciences. Le second argument repose sur l’idée que les sciences devraient être sensibles aux procédures présentant le meilleur potentiel épistémique. Pour ces deux raisons, si elle prend position en faveur d’idéaux normatifs, l’économie du bien-être devrait se tourner vers une approche délibérative, rationnelle et impartiale pour y parvenir. L’objectif de cette article est de comprendre la neutralité axiologique non pas comme une exigence épistémologique, mais plutôt comme un idéal éducationnel. Max Weber propose une science basée sur la description factuelle, de laquelle on exclut la formulation de jugements de valeur. Or, il faut démontrer pourquoi il est préférable de séparer les jugements descriptifs des jugements évaluatifs. L’objectif de Weber est de préserver l'autonomie intellectuelle des étudiants. Pour Weber, la classe et l'académie en général sont des lieux politiques. Ces (...) rapports au sein de la classe sont nécessaires pour transmettre des connaissances, des méthodes et le goût de l'autonomie intellectuelle. Or, il serait contraire au principe d'autonomie de laisser le professeur influencer et convaincre ses étudiants, de façon partisane, d'adhérer à certaines thèses normatives. Weber propose ainsi un mécanisme pour éviter que le professeur n'ixnfluence ses étudiants de manière illégitime. (shrink)

This paper examines 18th-century Annamese Neo-Confucian discourse on conceptual issues related to zhongguo and the hua-yi dichotomy as expressed across a diversity of 18th-century writings. I engage with Huang Chun-chieh’s theory of “contextual turn” and localized subjectivity in 18th-century East Asian Confucianisms by arguing that 18th-century Annamese Neo-Confucianism operated along a dissimilar ideological trajectory which affirmed “geographic China, political China, and cultural China” as a transdynastic and singular zhongguo from which Annam received its politico-cultural legitimation and prestige. This discourse of (...) dependence on institutional recognition and geographical connection to the Chinese zhongguo distinguished 18th-century Annamese literati not only from contemporaneous modes of Confucian intellectuality in Japan and Joseon, but also from foundational conceptions of Vietic statehood characteristic of the early Le dynasty. My analysis of metaphysical theories invoked by 18th-century Annamese literati in their discussions of zhongguo and the rise of human civilization engages with both Huang Chun-chieh’s theory of a philological turn away from the metaphysical commitments in 18th-century East Asian Confucianisms and Alexander Woodside’s theory of pre-modern Vietnamese Confucianism being characterized by a non-metaphysical “classical primordialism.”. On compte, parmi les nombreux ennemis de Kevin Mulligan, une foule de personnes bigarrées et (selon notre professeur) profondément vicieuses : les philosophes continentaux, les pharisiens, les amis de l’Europe, des Droits de l’Homme, du politiquement correct, des lettres, des études genres et bien sûr, les gauchistes. On peut faire remonter le terme "gauchiste" à Lénine (1920) qui en usait pour designer cette gauche (communiste) qui, pour rester fidèle à son idéologie, refusait de participer aux élections et, par conséquent, (...) était condamnée à rester éternellement un groupuscule. Pour Vladimir Illich, le vice des gauchistes est prudentiel : parce qu’ils sont focalisés sur leur idéologie, les gauchistes n’agissent pas pour prendre le pouvoir. Ce vice est doublé d’une faute épistémique : en s’arc-boutant (comme des enfants) sur leurs principes – quitte à ne jamais voir leurs idées aboutir –, les gauchistes sont bêtes. Le reproche de Lénine n’est pas très éloigné de celui que l’on fait habituellement à la gauche : elle a de grands rêves irréalisables qu’elle ne cherche jamais à concrétiser – ou de manière magistralement infantile. Cette vision du gauchiste comme un brave hippie un peu benêt sous-estime largement, à mon sens, les vices instanciés par les personnes atteintes de cette maladie politique. -/- Dans cet article, je vous propose d’explorer avec moi tous les vices du gauchisme en regardant, pour commencer, (I) ce que sont la gauche et la droite, puis en avançant pas à pas, (II) une définition en conditions nécessaires et suffisantes du gauchisme. Il conviendra également de ne pas oublier son opposé, tout aussi dangereux (et trop méconnu), le droitisme. C’est pourquoi, une fois que nous aurons caractérisé le gauchisme, je proposerai (III) une définition du droitisme en détaillant ses vices les plus inavouables. Nous pourrons alors (IV) identifier ce qu’est, en général, cette maladie infantile de la politique, suite à quoi (V) je vous prescrirai un vaccin pour vous en prémunir. Avant de débuter, il convient de préciser que si nous parlons ici de gauchisme et de droitisme, nous ne faisons aucune assomption concernant la gauche et la droite ; une personne de gauche n’est pas nécessairement un gauchiste ; de même, tout homme ou femme de droite qui se respecte cherche à tout prix à éviter les droitistes (et vice versa). With Jan Degenaar and Kevin O’Regan’s (D&O) critique of (what they call) ‘autopoietic enactivism’ as point of departure, this article seeks to revisit, refine, and develop phenomenology’s significance for the enactive view. Arguing that D&O’s ‘sensorimotor theory’ fails to do justice to perceptual meaning, the article unfolds by (1) connecting this meaning to the notion of enaction as a meaningful co-definition of perceiver and perceived, (2) recounting phenomenological reasons for conceiving of the perceiving subject as a living body, and (...) (3) showing how the phenomenological perspective does a better job at fulfilling D&O’s requirement for grounding notions of mentality in ‘outer’ criteria than they do. The picture that thus emerges is one of perceptual meaning as an integration of lived, living, and behavioral aspects – a structure of behavior that cannot be captured by appeal to sensorimotor capacities alone but that is adequately illuminated by the enactive notion of adaptive autonomy. abstract: Richard T. Greener was the first Black graduate of Harvard College in 1870, and he served briefly as a professor of philosophy at the University of South Carolina from 1873 to 1877. Historians and biographers have uncovered many of the facts of his unusual life, but to date his philosophy has remained unappreciated. This essay reconstructs his philosophy from published and archival sources, evaluating it in relationship to the work of his better-known mentor, Frederick Douglass. I argue that Greener’s (...) account of Reconstruction politics, especially his arguments on land redistribution, race, and Black intellectual history, possess notable advantages over Douglass’s views. Of particular importance is that he defended a more robust republican state than did his hero, while rejecting the originalism and constitutionalism that characterize Douglass’s liberalism. (shrink)

The Lockean Thesis says that you must believe p iff you’re sufficiently confident of it. On some versions, the 'must' asserts a metaphysical connection; on others, it asserts a normative one. On some versions, 'sufficiently confident' refers to a fixed threshold of credence; on others, it varies with proposition and context. Claim: the Lockean Thesis follows from epistemic utility theory—the view that rational requirements are constrained by the norm to promote accuracy. Lockeanism; moreover, a plausible version of epistemic utility theory meshes with natural language considerations, yielding a new Lockean picture that helps to model and explain the role of beliefs in inquiry and conversation. Your beliefs are your best guesses in response to the epistemic priorities of your context. Upshot: we have a new approach to the epistemology and semantics of belief. And it has teeth. It implies that the role of beliefs is fundamentally different than many have thought, and in fact supports a metaphysical reduction of belief to credence. (shrink)

The research focuses on how the Nguyen dynasty it became the first to have the largest territory in the history of Vietnam in its nearly 60 years of establishing and reigning over the unified country in the first half of the 19th century. It is seen that in terms of organizing the state apparatus, Gia Long and Minh Mang retained the system of agencies of the previous dynasties and continued reforms to ensure socio-political stability in their governance at that time. The study also clarifies the social role of Confucianism in the Nguyen dynasty, i.e. in the first half of the 19th century, which, in our opinion, is theoretically and practically significant, with the hope of further unraveling the role of Confucianism in that period. The idea that there could be spatially extended mereological simples has recently been defended by a number of metaphysicians (Markosian 1998, 2004; Simons 2004; Parsons (2000) also takes the idea seriously). Peter Simons (2004) goes further, arguing not only that spatially extended mereological simples (henceforth just extended simples) are possible, but that it is more plausible that our world is composed of such simples, than that it is composed of either point-sized simples, or of atomless gunk. The difficulty for these (...) views lies in explaining why it is that the various sub-volumes of space occupied by such simples, are not occupied by proper parts of those simples. Intuitively at least, many of us find compelling the idea that spatially extended objects have proper parts at every sub-volume of the region they occupy. It seems that the defender of extended simples must reject a seemingly plausible claim, what Simons calls the geometric correspondence principle (GCP): that any (spatially) extended object has parts that correspond to the parts of the region that it occupies (Simons 2004: 371). We disagree. We think that GCP is a plausible principle. We also think it is plausible that our world is composed of extended simples. We reconcile these two notions by two means. On the one hand we pay closer attention to the physics of our world. On the other hand, we consider what happens when our concept of something—in this case space—contains elements not all of which are realized in anything, but instead key components are realized in different features of the world. One of the most frequently voiced criticisms of free will skepticism is that it is unable to adequately deal with criminal behavior and that the responses it would permit as justified are insufficient for acceptable social policy. This concern is fueled by two factors. The first is that one of the most prominent justifications for punishing criminals, retributivism, is incompatible with free will skepticism. The second concern is that alternative justifications that are not ruled out by the skeptical view per (...) se face significant independent moral objections. Yet despite these concerns, I maintain that free will skepticism leaves intact other ways to respond to criminal behavior—in particular preventive detention, rehabilitation, and alteration of relevant social conditions—and that these methods are both morally justifiable and sufficient for good social policy. The position I defend is similar to Derk Pereboom’s, taking as its starting point his quarantine analogy, but it sets out to develop the quarantine model within a broader justificatory framework drawn from public health ethics. The resulting model—which I call the public health -quarantine model—provides a framework for justifying quarantine and criminal sanctions that is more humane than retributivism and preferable to other non-retributive alternatives. It also provides a broader approach to criminal behavior than Pereboom’s quarantine analogy does on its own. (shrink)

Much of the recent philosophical discussion about free will has been focused on whether compatibilists can adequately defend how a determined agent could exercise the type of free will that would enable the agent to be morally responsible in what has been called the basic desert sense :5–24, 1994; Fischer in Four views on free will, Wiley, Hoboken, 2007; Vargas in Four views on free will, Wiley, Hoboken, 2007; Vargas in Philos Stud, 144:45–62, 2009). While we agree with Derk Pereboom (...) and others that the compatibilist’s burden should be properly understood as providing a compelling account of how a determined agent could be morally responsible in the basic desert sense, the exact nature of this burden has been rendered somewhat unclear by the fact that there has been no definitive account given as to what the basic desert sense of moral responsibility amounts to. In Sect. 1 we set out to clarify the compatibilist’s burden by presenting our account of basic desert moral responsibility—which we call retributivist desert moral responsibility for purposes of clarity—and explain why it is of central philosophical and practical importance to the free will debate. In Sect. 2 we employ a thought experiment to illustrate the kind of difficulty that compatibilists of any stripe are likely to encounter in attempting to explain how determined agents can exercise the kind of free will needed for retributivist desert moral responsibility. This chapter proposes a radically enactive account of remembering that casts it as creative, dynamic, and wide-reaching. It paints a picture of remembering that no longer conceives of it as involving passive recollections – always occurring wholly and solely inside heads. Integrating empirical findings from various sources, the chapter puts pressure on familiar cognitivist visions of remembering. Pivotally, it is argued, that we achieve a stronger and more elegant account of remembering by abandoning the widely held assumption that it is (...) rooted in the retrieval of stored information or content in order to represent past events. We demonstrate how a radically enactive account of the roots of remembering can successfully handle classic cases discussed in the extended memory literature while, at same time, accommodating experientially rich forms of episodic memory. It also provides a broader approach to criminal behavior than Pereboom’s quarantine analogy does on its own since it prioritizes prevention and social justice. -/- In Section 1, I begin by (very) briefly summarizing my arguments against free will and basic desert moral responsibility. In Section 2, I then introduce and defend my public health-quarantine model, which is a non-retributive alternative to criminal punishment that prioritizes prevention and social justice. In Sections 3 and 4, I take up and respond to two general objections to the public health-quarantine model. Since objections by Michael Corrado (2016), John Lemos (2016), Saul Smilanksy (2011, 2017), and Victor Tadros (2017) have been addressed in detail elsewhere (see Pereboom 2017a; Pereboom and Caruso 2018), I will here focus on objections that have not yet been addressed. In particular, I will respond to concerns about proportionality, human dignity, and victims’ rights. I will argue that each of these concerns can be met and that in the end the public health-quarantine model offers a superior alternative to retributive punishment and other non-retributive accounts. Predictable polarization is everywhere: we can often predict how people’s opinions, including our own, will shift over time. Extant theories either neglect the fact that we can predict our own polarization, or explain it through irrational mechanisms. They needn’t. Empirical studies suggest that polarization is predictable when evidence is ambiguous, that is, when the rational response is not obvious. I show how Bayesians should model such ambiguity and then prove that—assuming rational updates are those which obey the value of evidence—ambiguity (...) is necessary and sufficient for the rationality of predictable polarization. The main theoretical result is that there can be a series of such updates, each of which is individually expected to make you more accurate, but which together will predictably polarize you. Polarization results from asymmetric increases in accuracy. This mechanism is not only theoretically possible, but empirically plausible. I argue that cognitive search—searching a cognitively accessible space for a particular item—often yields asymmetrically ambiguous evidence, I present an experiment supporting its polarizing effects, and I use simulations to show how it can explain two of the core causes of polarization: confirmation bias and the group polarization effect. There is consensus within the chemosciences that olfactory perception is of the molecular structure of chemical compounds, yet within philosophical theories of smell there is little agreement about the nature of smell. The paper critically assesses the current state of debate regarding smells within philosophy in the hopes of setting it upon firm scientific footing. The theories to be covered are: Naïve Realism, Hedonic Theories, Process Theory, Odor Theories, and non-Objectivist Theories. The aforementioned theories will be evaluated based on their (...) explanations of the (a) the olfactory quality of a smell, (b) smells as distal entities, and (c) our experience of smells as intentional objects. The paper concludes with a defense of Molecular Structure Theory that demonstrating its superiority in accounting for each of these three aspects of smell. (shrink)

Atomically precise manufacturing (APM) is the assembly of materials with atomic precision. APM does not currently exist, and may not be feasible, but if it is feasible, then the societal impacts could be dramatic. This paper assesses the net societal impacts of APM across the full range of important APM sectors: general material wealth, environmental issues, military affairs, surveillance, artificial intelligence, and space travel. Positive effects were found for material wealth, the environment, military affairs (specifically nuclear disarmament), and space travel. (...) Negative effects were found for military affairs (specifically rogue actor violence and AI. The net effect for surveillance was ambiguous. The effects for the environment, military affairs, and AI appear to be the largest, with the environment perhaps being the largest of these, suggesting that APM would be net beneficial to society. However, these factors are not well quantified and no definitive conclusion can be made. One conclusion that can be reached is that if APM R&D is pursued, it should go hand-in-hand with effective governance strategies to increase the benefits and reduce the harms. (shrink)

We perceive smells as perduring complex entities within a distal array that might be conceived of as smellscapes. However, the philosophical orthodoxy of Odor Theories has been to deny that smells are perceived as having a distal location. Recent challenges have been mounted to Odor Theories’ veracity in handling the timescale of olfactory perception, how it individuates odors as a distal entities, and their claim that olfactory perception is not spatial. The paper does not aim to dispute these criticisms. Rather, (...) what will be shown is that Molecular Structure Theory, a refinement of Odor Theory, can be further developed to handle these challenges. The theory is further refined by focusing on distal perception that requires considering the perceptual object as mereologically complex persisting odor against a background scene conceived of as a smellscape. What will be offered is an expansion of Molecular Structure Theory to account for distal smell perception within natural environments. (shrink)

Relationships with international students can be beneficial to higher education in terms of financial and human resources. For this reason, establishing and maintaining such relationships are usually pre-eminent concerns. In this study, we extended the application of the disconfirmation expectation model by incorporating components from subjective task value to predict the loyalty of international students toward their host countries. On a sample of 410 Vietnamese students enrolled in establishments of higher education in over 15 countries across the globe, we employed (...) structural equation model to construct the conceptual model. Our empirical findings revealed that while the roles of satisfaction and disconfirmation are still important as direct and indirect antecedents of international student loyalty, its most powerful predictors are the three components of subjective task value: attainment, utility and intrinsic. These insights result in a number of implications for actors on the higher ducation scene, such as heads of institutions and policy makers. (shrink)

Of the dozens of purported solutions to the liar paradox published in the past fifty years, the vast majority are "traditional" in the sense that they reject one of the premises or inference rules that are used to derive the paradoxical conclusion. Over the years, however, several philosophers have developed an alternative to the traditional approaches; according to them, our very competence with the concept of truth leads us to accept that the reasoning used to derive the paradox is sound. (...) That is, our conceptual competence leads us into inconsistency. I call this alternative the inconsistency approach to the liar. Although this approach has many positive features, I argue that several of the well-developed versions of it that have appeared recently are unacceptable. In particular, they do not recognize that if truth is an inconsistent concept, then we should replace it with new concepts that do the work of truth without giving rise to paradoxes. I outline an inconsistency approach to the liar paradox that satisfies this condition. (shrink)

Some Anglophone legal theorists look to analytic philosophy for core presuppositions. For example, the epistemological theories of Ludwig Wittgenstein and Willard Quine shape the theories of Dennis Patterson and Brian Leiter, respectively. These epistemologies are anti-foundational since they reject the kind of certain grounding that is exemplified in Cartesian philosophy. And, they are coherentist in that they seek to legitimate truth-claims by reference to entire linguistic systems. While these theories are insightful, the current context of information and communication technologies (ICT) (...) has created new informational concepts and issues. As a result, the analytic epistemologies are increasingly challenged by alternative perspectives. One such alternative is Structural Realism (SR), which is influential among the natural sciences, and especially physics. “Informational Structural Realism,” (ISR) is a variant of SR that was introduced by Luciano Floridi. Unlike the coherentist theories, ISR promotes examination of the connections among types of information and informational structures. It is an important shift for legal theory today, since the challenges that the ICT presents have to do with pattern recognition across vast domains of diverse data. An informational jurisprudence is now required to understand the issues emerging from the ICT. (shrink)

In the first months of the COVID-19 pandemic, we created and implemented from November 2020 to February 2021 a monthly educational pilot program of philosophical management of stress based on Science, Humanism and Epicurean Pragmatism, which was offered to employees of 26 municipalities in the Prefecture of Attica, Greece. The program named “Philosophical Distress Management Operation System” (Philo.Di.M.O.S.) is novel and unique in its kind, as it combines a certain Greek philosophical tradition (Epicurean) that concurs with modern scientific knowledge. The (...) program was designed to be implemented in a period of crisis; therefore, it used a fast-paced, easy to learn and practice philosophical approach to stress management, based on cognitive psychotherapy. The philosophical approach to stress management has the advantage that it can be offered to most people, regardless of age and educational level. The pilot program was effective in achieving its objectives, shown by statistical comparisons of the trainees’ responses to anonymous questionnaires before and after the month-long training. The successful Philo.Di.M.O.S. program, thus, based on a solid scientific and philosophical basis, offers a paradigm of stress management during crises and could be useful in Greece and internationally.
